We do not use the content of your private support communications to train publicly available third-party generative-AI models.
5. ARTIFICIAL INTELLIGENCE AND AUTOMATED PROCESSING
The Services incorporate artificial-intelligence, machine-learning, and automated-processing components. This section describes how personal and operational information relates to them.
A. HOW AUTOMATED PROCESSING IS USED
We may use automated processing to:
i. evaluate, score, rank, or filter potential trades within the software;
ii. detect fraud, abuse, duplicate accounts, or security threats;
iii. segment audiences and personalize marketing content;
iv. score or prioritize leads and support tickets;
v. draft or suggest responses to support inquiries; and
vi. analyze aggregate usage to improve reliability and performance.
B. TRAINING AND MODEL IMPROVEMENT
We may use operational data, configuration data, execution metadata, error logs, and outcome data generated through use of the Services to evaluate, calibrate, retrain, and improve the models and logic used in the Services. Where feasible, such data is aggregated, de-identified, or pseudonymized for this purpose. We do not commit to using identifiable personal information for model training and will not do so where prohibited by applicable law without a lawful basis or required consent.
C. THIRD-PARTY AI PROVIDERS
We may transmit certain information to third-party artificial-intelligence or model-hosting providers to deliver features or generate content. Those providers process information under their own terms, and we endeavor to use providers that contractually restrict use of our data for their own model training. We cannot guarantee the practices of any third party.
D. LIMITATIONS
Automated outputs are probabilistic and may be inaccurate. Automated processing is not a substitute for human judgment and is not used by us to make decisions producing legal or similarly significant effects concerning you without a lawful basis and, where required, human review.
E. YOUR RIGHTS
Depending on your jurisdiction, you may have the right to be informed about, object to, opt out of, request human review of, or receive an explanation concerning automated decision-making and profiling. See Section 13.
F. AI IN MARKETING CONTENT
Some content we publish or send, including copy, images, video, audio, and support replies, may be generated or assisted by artificial-intelligence tools. See the Disclaimer for further detail.
6. LEGAL BASES FOR PROCESSING (EEA, UK, AND SIMILAR JURISDICTIONS)
Where the EU or UK General Data Protection Regulation or a similar law applies, we process personal information on the following legal bases:
a. PERFORMANCE OF A CONTRACT, to provide the Services you have requested, operate your account, and process billing;
b. LEGITIMATE INTERESTS, to secure and improve the Services, prevent fraud, conduct analytics, and market to existing customers, where such interests are not overridden by your rights;
c. CONSENT, for marketing communications where required, for non-essential cookies and tracking, and for any processing that requires consent, which you may withdraw at any time without affecting prior lawful processing; and
d. LEGAL OBLIGATION, to comply with applicable law, tax, accounting, and regulatory requirements.
7. EMAIL, TEXT, AND PROMOTIONAL COMMUNICATIONS
By purchasing, subscribing, registering, or otherwise providing your contact information, you may receive communications from the Company relating to the Services and, where permitted by law, marketing and promotional communications.

You may opt out of promotional email by using the unsubscribe link in the email or by contacting us. You may opt out of marketing text messages by replying STOP or by another reasonable opt-out method. Revocation of consent may be made in any reasonable manner and will be honored within a reasonable time not to exceed ten business days. Message and data rates may apply, message frequency varies, and you may reply HELP for assistance.
Commercial email includes accurate sender information, a valid physical postal address, and a functioning opt-out mechanism.
Opting out of promotional communications does not prevent us from sending transactional, service-related, security, billing, or other non-promotional communications where permitted by law.
We maintain suppression records of opt-outs in order to honor them, and we retain those records even if you otherwise request deletion, because doing so is necessary to continue honoring your opt-out.
8. SALE AND SHARING OF PERSONAL INFORMATION
To the extent permitted by applicable law, we may sell, share, license, rent, disclose, or otherwise make available certain categories of personal information to third parties, including advertisers, advertising networks, marketing partners, analytics providers, lead-generation partners, data partners, commercial partners, and other businesses.

We and our service providers may use cookies, pixels, local storage, tags, SDKs, and similar technologies to:
a. keep users logged in or maintain settings;
b. measure traffic, conversions, and attribution;
c. understand user behavior;
d. improve site and service performance;
e. personalize content or offers;
f. conduct advertising or retargeting; and
g. support fraud prevention and security.
Your browser settings, device settings, or available consent tools may provide ways to manage these technologies. Blocking some technologies may impair functionality.
DO NOT TRACK. Because no common industry standard for "Do Not Track" browser signals has been adopted, we do not currently respond to them. We do honor recognized opt-out preference signals as described in Section 8.
10. HOW WE DISCLOSE INFORMATION
We may disclose personal information to:
a. billing and payment processors, including Whop;
b. NinjaTrader, TradersPost, and other integration or automation providers;
c. brokers, exchanges, or connection partners where authorized by you or necessary to provide the Services;

Service providers are engaged under terms that limit their use of personal information to performing services for us, except where they act as independent third parties for their own purposes as disclosed in Section 8.
11. OPERATIONAL LOGS AND MONITORING
We may maintain technical logs, audit records, support logs, troubleshooting data, configuration history, error reports, and operational event history relating to your use of the Services. We use this information for security, fraud prevention, support, service reliability, debugging, internal analytics, model evaluation, legal compliance, and enforcement of our agreements.

b. maintain business, billing, tax, and compliance records;
c. support security and fraud prevention;
d. document consents, opt-outs, and marketing suppression;
e. resolve disputes;

When information is no longer needed, we delete, de-identify, or aggregate it, or securely isolate it where deletion is not reasonably feasible.

Where required, we rely on appropriate safeguards for such transfers, which may include Standard Contractual Clauses approved by the European Commission or the UK International Data Transfer Agreement or Addendum, or another lawful transfer mechanism.
By using the Services, you consent to such transfers to the extent permitted by applicable law.
If you are in the EEA or UK, you have the right to lodge a complaint with your local supervisory authority. We encourage you to contact us first so we can address your concern.

We may update this Privacy Policy from time to time. The updated version becomes effective when posted, unless a later effective date is stated. Material changes will be indicated by updating the "Last Updated" date and, where required by law, by additional notice. Your continued use of the Services after the effective date constitutes acknowledgment of the updated Policy.
